Terms of Use & Privacy Policy

This portal (the “Service”) is operated by Pen&Public (“we,” “us”) to coordinate festival production for our clients. By accessing or using the Service you agree to these Terms of Use and to the Privacy Policy below. If you do not agree, do not access or use the Service.

1. Authorized access only

The Service is a private system for authorized users only. Access is granted by invitation for the sole purpose of performing work for the applicable festival. You may not access the Service, or any data in it, without authorization or beyond the scope of your authorization. Unauthorized access, use, or extraction of data is strictly prohibited and may violate the U.S. Computer Fraud and Abuse Act (18 U.S.C. § 1030), state computer-crime and data-protection laws, and other applicable regulations. Activity on the Service may be monitored and logged.

2. Proprietary rights

The Service — including its software, design, structure, text, and all related intellectual property — is owned by Pen&Public and is protected by copyright and other laws. You receive a limited, revocable, non-exclusive, non-transferable license to use the Service for its intended purpose. No ownership or other rights are transferred to you. You may not copy, modify, distribute, sell, sublicense, reverse-engineer, or create derivative or competing works from the Service or its contents.

3. Acceptable use

You agree not to: (a) share your login credentials or let anyone else use your account; (b) scrape, harvest, bulk-export, or use automated means to access the Service or its data except features we provide; (c) access data you are not authorized to view; (d) attempt to defeat, probe, or circumvent any security or access control; (e) disclose, transfer, or use any data from the Service outside the authorized purpose; or (f) use the Service for any unlawful purpose.

4. Confidentiality

All information in the Service — including personnel, vendor, logistics, and planning data — is confidential and proprietary to the applicable festival and/or Pen&Public. You must keep it confidential, use it only for the authorized purpose, and not disclose it to any third party without authorization.

5. Accounts & security

You are responsible for activity under your account and for keeping your access secure. Notify us immediately if you believe your account or any data has been accessed without authorization. We use reasonable technical and organizational measures to protect the Service, but no system is perfectly secure.

6. Privacy Policy

What we collect. Account and contact details you or an administrator provide (name, email, phone, company, title), the data you enter into the Service, and limited usage information (such as sign-in time and activity needed to operate and secure the Service).

Why. We use this information solely to provide, operate, secure, and support the Service for festival production coordination, and to communicate with you about it (for example, sign-in codes and invitations).

On whose behalf. We process personal information on behalf of, and under instruction from, the applicable festival, which is responsible for the data it asks us to handle. We do not sell personal information or use it for advertising.

Sharing. Information is visible to authorized users of the applicable festival according to their role, and to service providers that help us run the Service (for example, hosting and email delivery) under confidentiality obligations. We may disclose information if required by law.

Cookies. We use a single sign-in (session) cookie that is necessary to keep you logged in. We do not use advertising or tracking cookies.

Retention & your choices. We retain information for as long as needed to provide the Service or as the festival directs, and then delete or anonymize it. Depending on where you live, you may have rights to access, correct, or delete your personal information; contact us to make a request and we will route it appropriately.

7. Disclaimers & limitation of liability

The Service is provided “as is” without warranties of any kind. To the fullest extent permitted by law, Pen&Public is not liable for any indirect, incidental, special, or consequential damages, or for any loss arising from unauthorized access caused by a user’s failure to safeguard credentials or comply with these Terms.

8. Changes

We may update these Terms and this Privacy Policy from time to time. Continued use of the Service after an update means you accept the revised version.
